Minnesota is unique in having a residential real property arbitration program. To our knowledge, this type of residential arbitration program is not available in other states. Arbitration is an alternative to the court system when resolving disputes involving the physical condition of a property and in many cases it is quicker and less expensive than to going to court. Arbitration is an informal process that allows the home buyer and seller to present their views of the property condition dispute to a trained third party arbitrator's) who will decide how to resolve the dispute. Under the rules, all disputes regarding the physical condition of the property, including claims of fraud, misrepresentation, warranty and negligence, are covered under the Arbitration Agreement. MAR has revised the Arbitration Disclosure and Residential Real Property Arbitration Agreement (Rev. 2/03) specifying CAS as the new arbitration provider.
